Terms and conditions

AGREEMENT: “My Rental in San Miguel” (“Agent”), and Guest (“Renter”) agree as follows: The Renter must be an adult at least 21 years of age and will be an occupant of the rented property during the entire contracted period. Other occupants will be family members, friends or responsible adults. 

Use of the premises will be denied to persons not falling within the aforementioned categories and would have to vacate the property immediately.

In this case there are no refunds. No keys will be issued to anyone who is not an adult 21 years of age or older.

1.Renter Agrees to pay Owners for costs incurred to repair/replace any and all
damaged items during Renter’s stay. Renter understands that by signing below,
Renter is accepting liability for any damages caused to the property, or any excessive  cleaning fees (other than normal use) by Renter, his or her family and/or guests,  including, but not limited to, landscaping, misuse of appliances/heating system, plumbing, and/or equipment provided. Renter will pay reasonable attorney’s fees and court costs, if any, incurred by the Agent or Owner in enforcing this contract in court or otherwise to recover costs for damages.

Note: A separate deposit will be forwarded 45 days before arrival.
The security deposit is not to be considered as rent and will be returned to the Renter upon compliance with the following conditions: No long distance phone calls or localcalls over the 100 free ones, payment of all rent due. The property left in a clean habitable condition and the return of all keys. 

Deductions from the deposit will be made for any damage done to the property including scratches, burns, stains, holes in wall, as well as damage to personal property. 

The Deposit will be returned to you 3 months after leaving the property and in compliance with the above mentioned conditions (this time is required as the local telephone company sends its invoice with a 2 month delay). If there are extra charges a 20 U.S.D. processing fee will be charged. Limit of Liability.

2. PETS: 
Pets are allowed on the property

3. CANCELLATION: 
Due to the nature of the vacation rental business, if you cancel you will Forfeit all sums paid unless we are able to re-rent the property to another tenant, at the same rate, for the same period. We will do our best to do so, but there can be no guarantees. Short notice rentals are difficult to secure!

4. CHECK IN: 
Check in time is after 1:00 PM. Early Check-in times are allowed
only when the property has been cleaned, is ready for occupancy and prior approval has been given in writing.

5. CHECK OUT: 
Check out time is 10:00 AM. Prior written approval is needed for late checkouts. Please leave all keys, remote controls, and garage door openers (if issued) at the property on the kitchen counter. A replacement fee will be charged for each lost key ($25), remote control ($100), or garage door opener ($100).

6. CLEANING: 
Each property will be inspected and cleaned after your departure. You are required to leave the property in the same general condition in which it was received.

Should you arrive at the rental home and it has not been cleaned or there is an item broken or damaged, you must call 15 267 52 within the first 4 hours of check in. 

If there is no answer, leave a Message. If we do not receive a call or message, we will assume the property was clean and ready for your arrival.

7. TELEPHONES: 
It is cheaper to use calling cards or call collect when making long distance telephone calls. There is no charge for local calls (up to 100 local phone calls per month).

8. WHAT WE SUPPLY: 
The property is equipped and set up as a fully furnished
property that will include bedspreads, linens, blankets, pillows, towels, as well as a equipped kitchen, TVs, and furnishings. Although we make every effort to anticipate most people’s needs, WE MAY NOT HAVE ALL THE ITEMS YOU ARE

ACCUSTOMED TO HAVING AT YOUR OWN HOME. If there is a special type of item you are accustomed to using such as a special type of cooking utensil, etc. please bring it with you.

9. WHAT YOU SHOULD BRING or BUY:
 Although the bathroom will be cleaned and the house has fresh towels, you might want to bring with you personal items such as bath soap, shampoo, or any other personal toiletries. We also supply two water jugs (if the house doesn’t have purification system), two rolls of toilet paper for each bathroom. 

We make every effort to initially provide items such as Kleenex, paper towels, dish soap, cooking spices, salt, pepper, trash bags, and other non-perishable 
items. However, we do not supply unlimited quantities of these items and it is your responsibility to replace them.

10. SLEEPING CAPACITY/DISTURBANCES: 
Guests and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:

  • Occupancy exceeding the sleeping capacity stated on the reservation confirmation.
  • Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age.
  • Causing damage to the premises rented or to any of the neighboring properties.

11. HOLD HARMLESS / LIABILITY: 
The Owners or the Agent do not assume any liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. 

Nor will the Owners or the Agent accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, War, or other causes beyond the Owners’ control.

Should any unforeseen matter arise that concerns the Renter’s safety, or the Renter is unable to remain on the property due to failing services or appliances, the Agent must be contacted and each situation will be dealt with on an individual case basis.  

Under no circumstance may the Renter expect the Owners or the Agent to pay for alternative accommodations.

12. FIRES AND THE FIREPLACE: 
Homes with wood burning fireplaces do not come supplied with firewood. All firewood is at Renter’s expense. Gas fireplaces should be used with caution. We recommend not to leave them on at night.

13. GAS TANK: 
The owner will supply full tank(s) of propane gas for cooking, gas space heater(s), gas fireplace and water heater(s). One tank per month. 

Additional gas usage beyond initial tank(s) will be responsibility of the renter. Gas for swimming pool and Jacuzzi will be at Renter’s expense.

14. COMPLAINTS: 
Any complaints which Renter may have concerning the premises will be directed to the Agent during their regular working hours Monday through Friday : (9:00am – 4:00pm) and only if there is an emergency after hours or on the week ends .

15. OVERTIME AND TIPPING: 
Overtime worked by each household staff member, shall be paid by the Renter. The hourly wage for extra hours is 50 pesos. 
Any work performed before 9:00am or after 4:00pm, or Saturdays, Sundays or holidays will have to be paid double. (100 pesos per hour). 
We recommend the Renters to tip the personnel as follows: 100 pesos per week per household for each staff member.

16. CHILDREN: 
Children under 12 years old are allowed on the premises.

17. RIGHT TO INSPECT: 
Agent will have the right to show the premises to prospective clients with 24 hours notice to Renter at Renter’s convenience. The Agent has the right to inspect the premises at anytime if Agent has reasonable cause to believe that Renter or any other person is misusing or damaging the premises or furnishings therein.

18. ADDITIONAL TERMS AND CONDITIONS: 
In no event shall the Agent or owner be liable to Renter for any consequential or indirect damages, injury or for pain or suffering incurred by Renter in connection with this lease of the specified premises. 

The Agent or owner cannot be held responsible for any loss or theft of any property belonging to the Renter, his or her family, or visitors to the premises. The use of stairways, balconies and rooftops as well as gas and electrical appliances are at the Renter’s, his or her family’s or visitors’ own risk. 

If children are included in the rental party, the Renters are responsible for the behavior and actions of their children and any of the children’s friends or guests. Renters must agree personally to supervise children on the rental property especially in homes with swimming pools. 

It is understood that the household staff is present to perform cleaning and cooking duties only; they are not authorized to serve as baby sitters. This contract may be amended only by a written agreement executed by Agent and Renter. 

All discussions, understandings and agreements, whether written or verbal between the parties shall be governed and interpreted under the law of the Republic of Mexico.

The jurisdiction to which the Renter and Agent submit to in the Republic of Mexico is San Miguel de Allende, Guanajuato, expressly waiving any other jurisdiction that might correspond to them due to their present or future domiciles or due to any other cause.

19. PAYMENT : 
All rental amounts and security deposit will be paid in one of the following way :

a. You can send the payment through Paypal (email address: rentalsinsanmiguel@gmail.com.

b. Or you can make a deposit or send a wire transfer to the following bank :

20. I AGREE TO THE TERMS OF THIS CONTRACT AND WILL BE BOUND BY THE CONTENT HEREIN. I AM AWARE THAT I AM RENTING A  PRIVATE HOME. 
I WILL TREAT IT WITH THE SAME RESPECT I WOULD EXPECT TO BE SHOWN TO MY OWN HOME.
